These Terms of Service ("Terms") govern your access to and use of Motus Medicine ("we," "our," or "us"), a physical rehabilitation monitoring platform. By creating an account or using Motus Medicine, you agree to these Terms. If you do not agree, do not use Motus Medicine.

1. Who May Use Motus Medicine

Motus Medicine is intended exclusively for:

2. No Medical Advice or Guaranteed Outcomes

Motus Medicine is a communication and monitoring tool. Motus Medicine does not provide medical advice, diagnosis, or treatment. The platform facilitates the delivery of protocols prescribed by your licensed therapist — it does not replace the clinical judgment of that therapist.

Motus Medicine makes no guarantee of any specific medical or rehabilitation outcome. Actual results depend on patient adherence, the prescribed protocol, and clinical factors outside Motus Medicine's control.

If you experience pain, discomfort, or injury during exercises, stop immediately and contact your therapist or seek emergency care if appropriate.

3. Therapist Responsibility

Licensed therapists using Motus Medicine retain full clinical and legal responsibility for the rehabilitation protocols they assign, the monitoring decisions they make, and the care they provide to their patients. Motus Medicine is a tool to support that care — it does not supervise, audit, or guarantee the appropriateness of any therapist's clinical decisions.

Therapists are responsible for ensuring their use of Motus Medicine complies with applicable professional licensing requirements, scope-of-practice rules, and HIPAA obligations in their jurisdiction.

6. Health Data and Privacy

Your use of Motus Medicine involves the collection and processing of Protected Health Information (PHI) as defined by HIPAA. Our Privacy Policy and Notice of Privacy Practices describe in detail how we handle your health information. Both documents are incorporated into these Terms by reference.

7. Intellectual Property

Motus Medicine and its content (software, design, text, and graphics) are owned by or licensed to us and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Motus Medicine platform without our express written permission.

You retain ownership of the content you upload to Motus Medicine (session videos, messages). By uploading content, you grant us a limited license to store, process, and display that content solely to provide the service to you and your therapist.

8. Account Termination

You may delete your account at any time from within the app. Upon deletion, your account and associated health records will be permanently removed within 30 days, except where retention is required by law (e.g., HIPAA audit logs).

Motus Medicine is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Motus Medicine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or personal injury, arising from your use of the platform.

Nothing in these Terms limits liability for death or personal injury caused by our gross negligence, fraud, or any other liability that cannot be excluded by law.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of Motus Medicine shall be resolved exclusively in the state or federal courts located in Olmsted County, Minnesota.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or in-app notification for material changes. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of Motus Medicine after the effective date of revised Terms constitutes acceptance.
